Why cite Article 16
Article 16 of Regulation (EU) 2025/40 obliges packaging and material suppliers to make available to the manufacturer the information and documentation needed to demonstrate conformity. Citing it turns a courtesy into a duty, and shortens response times.
The template
Subject: Information request under Art. 16 Reg. (EU) 2025/40 — packaging supplied to [COMPANY].
Dear [SUPPLIER], we market products under our own brand packaged with components you supply and are therefore the manufacturer of the finished packaging under Articles 3 and 21 of Regulation (EU) 2025/40. For the components [LIST] we request: 1) material composition, including coatings, inks and adhesives; 2) unit weight in grams; 3) recycled content in percent; 4) a statement that the sum of Pb, Cd, Hg and Cr(VI) is ≤ 100 ppm, with reference to a certificate or test report; 5) for food-contact components, evidence of conformity with the PFAS limits of Article 5(5); 6) your own declaration of conformity for the component, if issued. We ask for a reply within 10 working days. The information will be kept in our technical documentation and made available to market-surveillance authorities on request.
