Terms of service
Agreement between Tom Riby, Gaiole in Chianti (SI), Italia ("Fascicolo", "we") and the customer purchasing a plan ("you"). The service is for businesses and professionals; consumer law does not apply. Last updated: 2026-08-31.
1. The service
Fascicolo is a data-collection and document-preparation tool for obligations under Regulation (EU) 2025/40: inventory of packaging types, sending and chasing supplier requests under Art. 16, formal checks of received evidence against the regulation's limits, drafting of technical documentation (Annex VII) and the EU declaration of conformity (Annex VIII), archiving.
2. What it is not
Not legal advice, not certification. For the Machinery service, Fascicolo does not carry out or sign the risk assessment under EN ISO 12100, nor any other safety engineering work: where required, this is carried out by an independent partner engineer who signs it under their own professional liability and insurance, with a direct relationship to the client for that scope. Fascicolo is responsible only for the documentation it drafts. We do not test materials. The declaration is issued and signed by your legal representative under their sole responsibility (Annex VIII, item 3). Automated checks are an aid, not a substitute for your judgement.
3. Your obligations
Provide complete and truthful data on your company, packaging and suppliers. Be entitled to share supplier contacts' data with us. Review documents before signing. Do not use the service for packaging of which you are not the manufacturer, importer or distributor under the regulation.
4. Plans and prices
Packaging (PPWR) — Start: €390 one-off, up to 5 packaging types. Producer: €890 one-off, up to 15 types. Extra type: €60. Custody: €24 per month. Machinery (Reg. EU 2023/1230) — Verifica 2027: €1,900 per machine family, delivered in 10 working days, credited against the Adeguamento quote if accepted within 60 days. Adeguamento: from €5,500 per machine family, fixed quote after the Verifica, first 3 months of Custody included. Custody Machinery: €190 per month per family, €290 where the machine has software-driven safety functions or notified-body certification. Prices exclude VAT unless stated at checkout. Laboratory testing, where needed, is separate and always quoted first.
5. Payment and invoicing
Payment in advance via Stripe (card or SEPA) or bank transfer against invoice. Custody renews automatically each year; cancel any time from the customer portal or by email, effective at the end of the current term.
6. Delivery
Documents are generated within 15 working days of suppliers completing their data. If a supplier does not respond we tell you and propose alternatives (different supplier, material-producer declaration, testing). We are not liable for supplier delays.
7. Refunds
Full refund on request before the first supplier request is sent. After that, one-off plans are non-refundable. Custody: no pro-rata refund on cancellation; the service stays active until the paid term ends.
8. Archiving and data access
With Custody we retain documents for 5 years (10 if reusable) and export them on request within 10 days. Without Custody, documents remain downloadable for 90 days after generation; retention is your responsibility. You can export your data at any time.
9. Liability
We are liable only for wilful misconduct or gross negligence. In all cases our total liability is capped at the amount you paid in the 12 months before the event. We are not liable for penalties, indirect loss or lost profit arising from inaccurate data supplied by you or your suppliers, or from regulatory changes after delivery.
10. Intellectual property
Generated documents are yours. The software, request templates, site content and brand remain ours. We name you as a customer only with your written consent.
11. Changes and termination
We may update these terms with 30 days' notice by email; changes do not apply to one-off plans already paid. We may suspend an account for abuse, with notice except in urgent cases.
